PichaPlus is a software platform that provides user-interface, content discovery, and access-management functionality. Content accessible through the platform is made available from systems and infrastructure operated by independent third-party service providers. PichaPlus does not own, operate, or maintain the servers, storage systems, or network infrastructure associated with such content. The platform provides tools for discovering, organizing, and accessing content delivered via third-party services.
This distinction is material to the application of this policy. DMCA Notices submitted to Picha Entertainment should reflect the nature of the platform as described above.
Picha Entertainment respects the intellectual property rights of copyright owners and expects all parties interacting with the platform to do the same.
It is the policy of Picha Entertainment to respond to copyright infringement notifications that are valid, complete, and submitted in compliance with applicable copyright law. Picha Entertainment reserves the right to verify the validity, accuracy, and authorization of any copyright complaint before taking any action in response to it.
Submission of a DMCA Notice to Picha Entertainment does not automatically result in the removal, restriction, or disabling of access to any content.
This policy applies to all copyright complaints directed at content accessible through the PichaPlus platform, regardless of where that content physically resides. Where content is stored on third-party infrastructure, Picha Entertainment will assess what action, if any, falls within its operational capacity and will respond accordingly.
Picha Entertainment does not accept responsibility for content residing on infrastructure it does not operate, own, or control. Where a complaint relates to content on third-party infrastructure, Picha Entertainment may direct the complainant to the relevant third-party provider as appropriate.

Where a DMCA Notice is submitted by a party claiming to act as an authorized representative or enforcement agency on behalf of a copyright owner, Picha Entertainment reserves the right to:

Picha Entertainment does not guarantee any specific outcome or timeline in response to a DMCA Notice.
Claims involving translations, subtitles, narrations, dubbed content, adaptations, or other derivative works require additional proof of ownership, authorization, or licensing rights over the specific derivative work or the underlying original work.
A claim of ownership over an original work does not automatically extend to all derivative works based on that original. Picha Entertainment reserves the right to request supporting documentation establishing the complainant's rights over the specific content identified in the notice before taking any action.
Submitting a DMCA Notice that is knowingly false, misleading, fraudulent, or inaccurate is strictly prohibited. Picha Entertainment reserves the right to reject any notice that appears to contain false or misleading information.
Consequences for submitting false or misleading notices are governed by the Picha Entertainment False Claims and Consequences Policy, which forms part of this framework.
Under Section 512(f) of the Digital Millennium Copyright Act, any person who knowingly materially misrepresents that content is infringing may be liable for damages, including costs and attorney fees.
Where content is removed or access is restricted as a result of a DMCA Notice, the affected party may be eligible to submit a Counter-Notice if they believe the action was taken in error, based on misidentification, or without valid legal basis.
Counter-Notices are subject to the Picha Entertainment Counter-Notice Policy.
Picha Entertainment maintains a Repeat Infringer Policy under which repeated valid copyright complaints involving the same account or content source may result in escalating action including content removal, access restriction, suspension, or permanent termination.
The Repeat Infringer Policy is available as a separate document forming part of this framework.
Picha Entertainment's obligations under this policy are limited to actions within its operational control as a software platform and access-management interface. Where content resides on third-party infrastructure that Picha Entertainment does not operate or control, Picha Entertainment's ability to act may be limited to restricting platform-level access to that content.
Picha Entertainment shall not be held liable for its inability to act on content residing on infrastructure outside its operational control.
Picha Entertainment reserves the right to amend this policy at any time. The current version of this policy shall apply to all notices received following the date of publication.
